Who we are
Splatterbox (Caddies Southend on Sea LTD). is a company registered in England trading at Caddies Comedy Club, 12 London Road, SS1 1NT and company registration number 10487850. In these terms and conditions references to "Splatterbox", "we", and "us" mean Caddies Southend on Sea LTD.
Your agreement with us
We operate themed walk-through attractions combining live actors, audio, animatronics and themed sets, in these terms and conditions they are referenced as “Experiences”. To participate in any of our experiences you must tick the relevant acceptance box when booking your tickets online to confirm you agree to these terms and conditions and any experience-specific rules and instructions (which together form a legally-binding agreement between you and us). These terms and conditions include important information about who we are, our obligations to you, and your obligations to us and other people. We draw your attention particularly to paragraphs 4-5, 10-12, 15 and 16. If you do not agree to comply with the agreement between you and us you must not participate in any of our experiences. Please note that no amendment you make to these terms and conditions or any experience-specific rules or instructions will be effective unless we specifically agree to it in writing.

Tickets, Booking & Pricing
Our experiences are not recommended for young children, women in late stages of pregnancy, or people with heart problems or of a nervous disposition or who have epilepsy or claustrophobia. Strobe lighting is used throughout the experiences, along with live actors, audio, and animatronics.
We reserve the right to refuse entry without explanation, and to alter, close or remove details or aspects without prior notice for technical, operational or other reasons. No refunds will be given in these circumstances.
Bookings are placed via our website only www.splatterbox.co.uk. A booking is placed by following the on-line procedure on the "BOOK NOW" page which, at the end, includes a check-box to confirm that you have read these terms and conditions. If checked, this constitutes your acceptance of these terms and conditions.
After successfully placing a booking, you will be provided with a Booking Reference Number [by e-mail]. A binding contract between us is formed when the Booking Reference Number is provided to you and until we send this to you, your booking constitutes an order which we are free to accept or reject.
Thereafter, we will send to the e-mail address you provided during the on-line booking procedure an e-mail confirming your booking. This e-mail is very important as it constitutes your proof of purchase and sets out the details of your booking. We take no responsibility should you not receive this e-mail due to junk or spam filtering, for example.
Should the details of your booking appear inaccurate or incomplete you must notify us immediately by telephone on +44 (0) 345 216 0200 upon which we may amend the details as appropriate at our discretion. We do not guarantee that we will amend these details.
Once a payment is received you will receive tickets to the email address supplied at the time of booking. These tickets must be brought with you and presented at the box office. We also accept tickets on a smart phone or tablet but the bar code must be clear. If tickets cannot be scanned on these devices we accept no responsibility and you will not be permitted entry.
Our prices are as stated on our site from time to time and are liable to change at any time.

When placing a booking, the total price will be confirmed. We reserve the right to correct any pricing errors, even after we have sent you the e-mail confirmation, but we will endeavour to do so as soon as we become aware of the error. We are under no obligation to permit you or any person(s) on behalf of whom you have placed a booking entry to the Experience at an incorrect (lower) price.

If you purchase a ticket for a cheaper time slot and turn up at a time when the ticket would be more expensive you will be required to pay the difference at box office without exception, this is subject to availability of said time slot.
Our prices include VAT, which is currently set at 5%.
Payment must be made in full at the time of booking by credit or debit card. We do not charge you for using your card. The prices that you see are the prices that you pay.
Participants under 18 years of age
We do not permit children under the age of 13 to enter our experiences. With any participant that is under 18 years of age, a parent or appropriate adult must determine whether that experience is suitable before allowing the child to participate. Children must at all times be accompanied by a parent or appropriate adult who must supervise that person's involvement, including their interaction with other guests and the actors, as we cannot do so.
Changes to experience
We reserve the right to make changes to experience rules and experience designs at any time. Therefore, experiences may have different game rules or designs to those advertised before their start. We will notify you of any such changes either through written or spoken instructions. Normally these changes will be for health and safety, risk management or related reasons. If you no longer wish to participate in an experience following a change to rules or designs you should notify us before the start of the experience and we will issue you with a replacement ticket for another experience or a refund. Providing a replacement ticket or refund will be our sole liability to you in these circumstances.
Your behaviour
When participating in one of our experiences you are responsible for ensuring that you do not put yourself or others at risk of injury or harm. For example, you must not climb buildings or obstacles, and you must take particular care not to run.
Property used as part of the experience is privately owned and you must ensure you do not damage any property whilst within the experience (including, but not limited to, buildings and vehicles).
You must not act in a way that threatens, intimidates, harasses, demeans or bullies any other participant, any actor, or member of our staff, or in a way that is otherwise unlawful.
If you breach any of the terms of your agreement with us, including particularly the obligations set out in this paragraph, we may prevent you from participating in an experience (if an experience has not already started) or continuing in a experience (if an experience has started). In these circumstances we will not provide you with a refund or allow you to participate in an alternative experience, and will have no further liability to you.
What to do if you experience a problem during your experience
If you see any person or property being put at risk when participating in an experience, or if you see another participant acting in a way that is contrary to these terms and conditions or any experience-specific rules or instructions, you must tell one of the organisers as soon as possible (even if that means interrupting your participation in an experience).
Our right to suspend or cancel
We reserve the right to suspend or cancel an experience at any time for any reason including, but not limited to, for bad weather (If an outdoor experience, confirmed at point of booking) or where we believe that any person or property may be harmed if an experience continues.
Your rights if we suspend or cancel
If we suspend or cancel an experience and the reason for the suspension or cancellation is not your fault we will offer you a ticket to participate in another of our experiences or a refund of the ticket price. Providing a replacement ticket or refund will be our sole liability to you if we suspend or cancel a game.
Your right to cancel a booking
We do not allow cancellations, unless agreed in writing by us - and is at the discretion of management.
Refunds
In all cases where we make a refund we will process the refund as soon as possible and always within 30 days of notice of cancellation (where you are automatically entitled to a refund) and 30 days of agreement to issue a refund (where a refund is in our discretion). We will usually issue a refund using the same method you used to pay.
Safety of your personal belongings
If you carry personal belongings or valuables with you when you enter an experience, you must take the same precautions to safeguard them as you would if you were in the place where an experience is taking place but not participating. If an experience is in an area you do not know you should familiarise yourself with the area before it starts. If you leave your personal belongings or valuables with us we do not accept any liability for loss or damage, and they are left at the owner’s risk.
Your health and mobility issues
If you have any health or mobility issues that may impair your participation in an experience, you can contact us in advance through our website, www.splatterbox.co.uk. While we cannot give you advice specific to your personal needs, we can give you more general information about what an experience involves to help you decide whether you would like to participate. We will not be liable to you if your ability to participate in an experience is limited by your health or mobility issues unless we have advised you incorrectly that a health or mobility issue of which you have notified us will not prevent you from participating in a game.
Alcohol consumption, smoking and food.
During the experience you will be undertaking physical activity and interacting with a variety of participants and actors. You must not consume any alcohol before or during the experience as this increases the likelihood that you or another person will get injured. If we believe that you have consumed or intend to consume alcohol before or during the experience, we reserve the right to exclude you from participating.
In addition, the carrying of alcohol during the experience is prohibited. If you carry alcohol while participating in the experience we will confiscate this from you. If you refuse to give us the alcohol you will be excluded from the experience. We do not accept any liability for any loss or damage to any alcohol confiscated during the experience.
Smoking or Eating during the experience is also prohibited; if you smoke or eat during the experience we will confiscate the items from you. If you refuse to give us the cigarettes and/or food, you will be excluded from the experience. We do not accept any liability for any loss or damage to any cigarettes and/or confiscated during the experience.
No refund will apply and you will not be permitted to participate in an alternative experience where you are excluded from an experience under this paragraph.
Consent to use of your image
Your hereby consent to the recording by still or moving image recording equipment of your image during your involvement in our experiences and you hereby consent to the use without payment of any such recorded still or moving image to publicise us, any of our events, and/or any of our partner organisations, and for any ancillary purpose, anywhere in the world, in any medium, for all time.
Use of your personal information and privacy
We will use personal information you give to us when booking online only for the purposes of administering your participation in that experience, but not for any marketing or other purposes unless you have opted into this. You must ensure that the information you provide to us is accurate and complete.
Our liability to you
(a) While we take care in designing our experiences to limit the risks involved in participating in them, any experience which involves physical activity involves some risk.
(b) You recognise that we cannot eliminate risk in our experiences entirely and that if you breach these terms and conditions or do not follow experience-specific rules or instructions you are likely to expose yourself to additional risk. Accordingly, we will not be liable to you for any loss or damage you suffer to the extent it arises out of your breach of these terms and conditions or your failure to follow any experience-specific rules or instructions.
(c) If you suffer any loss or damage because we breach these terms and conditions or otherwise act negligently towards you we shall only be liable to you to the extent that we could, at the time you enter this agreement, reasonably foresee the loss or damage you suffer.
(d) Nothing in these terms and conditions, however, operates to limit or exclude our liability for death or personal injury caused by our negligence or for fraud, or any other liability that cannot lawfully be excluded.
Governing law and courts
These terms and conditions shall be governed by and construed in accordance with the law of England and Wales. Any dispute arising under or in connection with these terms and conditions and your participation in any of our experiences shall be subject to the exclusive jurisdiction of the courts of England, to which you and we irrevocably submit.
